General terms and conditions

1. Performance and delivery

M.K. sells computers together with peripherals, accessories and exchanges the aforementioned parts. In addition, M.K. provides services on the mentioned devices, in particular services.
In the case of replacement of components, the parts to be replaced will be exchanged as quickly as possible. If the parts are in stock, the exchange will take place immediately.
Repairs will only be carried out if the defective part is in a condition suitable for repartition and has not been damaged by outside interference or repair attempts by third parties.
In the case of delivery of replacement parts before receipt of the part to be replaced (advance delivery), M.K. is entitled to charge the new price for the replaced part if the part sent is unworthy of repair.

If services have been rendered defectively, a guarantee exchange shall take place if the complaint is made in writing to M.K. within 5 working days.
The date of purchase from M.K. is decisive.

2. Calculation and terms of payment

In individual cases M.K. charges the prices shown in the respective valid price list of M.K. plus the respective value added tax. The respectively valid prices shall be communicated to the
customers in advance upon request. In the case of new parts, the respective valid daily prices of M.K. shall always be charged. These daily prices will be communicated upon request. Exchange prices
shall be agreed in writing in advance in each individual case.
In addition to the aforementioned price, the shipping and postage costs incurred in the individual case as well as all taxes and customs duties owed or to be paid by M.K. shall be added.
Furthermore, M.K. is entitled to charge a handling fee of 15,- EURO for goods with a value of less than 25,- EURO.

After the consignment has been handed over to the post office or to a forwarding agent or delivery company, the risk of accidental loss and damage shall pass to the customer.

All goods remain the property of M.K. until full payment of the respective underlying claim as well as all claims of M.K. against the respective customer.
An extended retention of title applies.
With regard to all claims against the respective customer, M.K. has a right of lien on all devices and components sent to M.K. by the customer.
(floppy disk, hard disk, power supply units, system board, printer etc.) of the respective customer.
At the customer's request, M.K. shall release items to the customer at its own discretion as soon as the market value of the customer's items held by M.K. exceeds the claims of M.K. against the customer.

3. Warranty

Even with the most careful work and inspection, defects cannot be excluded in individual cases. In the event of a defect, M.K. shall provide a warranty in accordance with the following provisions.
M.K. shall in any case be given the opportunity to rectify defective parts, provided that the rectification is reasonable for the customer. In addition, the statutory provisions shall apply.
Delivered parts are to be inspected immediately by the customer for possible defects. Any defects are to be reported to M.K. immediately. If the customer is a fully qualified merchant, defects and deviations in
quantity discrepancies must be reported immediately.

4. Postage and packaging

If incoming parts (especially monitors, complete computers, printers and notebooks) are poorly packaged, M.K. is entitled to produce protective packaging that can be used several times and to invoice the customer for this on a pro rata basis.
and to charge the customer proportionally in order to avoid possible transport damages. Transport damages have to be reported to the customer within 2 days after receipt of the goods.

5. Exchange programme / EXCHANGE

If exchange parts are purchased, the exchanged old part must be received by us within 5 working days, otherwise the difference to the new part will be charged. Return of parts only in
original packaging and carriage paid.
